These Terms and Conditions set out the basis on which we provide waste disposal and waste collection services in Bow and surrounding areas. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following definitions apply:
1.1 Service means any waste collection, removal, disposal, recycling, or related service that we provide.
1.2 Customer means any individual, business, organisation, or other entity that books or uses our Service.
1.3 Waste means any materials, items, refuse, rubbish, junk, litter, or other substances that the Customer presents for collection and disposal.
1.4 Booking means a confirmed request for our Service made by the Customer and accepted by us.
1.5 Site means the property, premises, or location at which we are instructed to provide the Service.
1.6 Terms means these Terms and Conditions as amended from time to time.
2.1 We provide waste disposal and waste collection services in Bow and nearby locations, subject to availability and operational constraints. We reserve the right to refuse or limit services if the Site or type of Waste falls outside our operational or regulatory capabilities.
2.2 Our Service covers the collection and lawful disposal or recycling of Waste that complies with applicable UK waste regulations and with the description provided by the Customer at the time of Booking.
2.3 We do not handle all types of Waste. Certain categories, such as hazardous waste, clinical waste, asbestos, gas bottles, chemicals, solvents, and electrical items, may be excluded or subject to special terms and additional charges. It is the Customer's responsibility to accurately declare the nature of the Waste in advance.
2.4 Any estimated time of arrival or completion provided at the time of Booking is an estimate only and is not guaranteed. We will use reasonable efforts to deliver the Service at the agreed time but accept no liability for delays caused by traffic, access issues, adverse weather, or other circumstances beyond our reasonable control.
3.1 Bookings may be made by telephone, email, or through our online booking system if available. A Booking is not confirmed until we have accepted it and provided a confirmation by verbal agreement, email, or written communication.
3.2 At the time of Booking, the Customer must provide accurate information, including but not limited to:
a) The full address of the Site in Bow or the relevant service area.
b) Contact details for access and communication.
d) Any relevant access restrictions, parking limitations, or special instructions.
3.3 We reserve the right to refuse or cancel any Booking if the information provided is incomplete, misleading, or if the Service would be unsafe, unlawful, or impracticable.
3.4 Quotations provided before Booking are based on the information supplied by the Customer. If, upon arrival, the actual volume, weight, or type of Waste differs from that described, we may revise the quotation, apply additional charges, or decline to provide some or all of the Service.
4.1 The Customer must ensure that we have safe, reasonable, and lawful access to the Site at the agreed time. This includes arranging necessary permissions, passes, or keys and ensuring that the Waste is accessible.
4.2 The Customer must ensure that parking arrangements comply with local rules and that our vehicles can safely stop and load. Any parking charges or penalties incurred while providing the Service due to the Customer's failure to arrange adequate parking may be charged to the Customer.
4.3 The Customer is responsible for ensuring that the Waste presented for collection is free from prohibited or undeclared hazardous materials. If such materials are discovered, we may suspend the Service, refuse collection, or apply additional charges for safe handling and disposal in accordance with law.
4.4 The Customer must not request or allow our personnel to perform tasks outside the agreed scope of the Service, including but not limited to structural works, dismantling beyond reasonable removal, or tasks that may pose health and safety risks.
5.1 Prices are normally quoted based on the description of Waste and the nature of the Service requested. Final charges may be adjusted if the actual volume, weight, or type of Waste differs from that initially described.
5.2 All prices are stated in pounds sterling and may be subject to VAT or other applicable taxes as required by law.
5.3 Payment terms will be communicated at the time of Booking. Unless otherwise agreed in writing, payment is due on or before completion of the Service. We may require full or partial payment in advance to secure a Booking.
5.4 Payment may be made by cash, bank transfer, debit card, credit card, or other accepted methods as notified from time to time. We reserve the right to refuse certain payment methods for operational or security reasons.
5.5 If payment is not made in accordance with the agreed terms, we may charge interest on late payments at the statutory rate or at a rate notified to the Customer, as well as reasonable costs of recovery.
6.1 The Customer may cancel or amend a Booking by giving us as much notice as reasonably possible.
6.2 For cancellations made at least 24 hours before the scheduled Service time, any advance payment may be refunded or credited, subject to deduction of any non-recoverable costs already incurred by us.
6.3 For cancellations made less than 24 hours before the scheduled Service time, we reserve the right to retain all or part of any advance payment, or to charge a cancellation fee reflecting reasonable administrative and operational costs.
6.4 If we are unable to access the Site due to factors within the Customer's control, including the absence of an authorised representative, locked access, or unsafe conditions, this may be treated as a same-day cancellation, and applicable charges may be applied.
6.5 We reserve the right to cancel or reschedule the Service at any time if we are unable to perform it for reasons beyond our control, including vehicle breakdown, staff illness, severe weather, or legal or regulatory restrictions. In such cases, we will offer an alternative date or a refund of any pre-paid amounts for the affected Service.
7.1 We operate in accordance with applicable UK waste management laws, regulations, and codes of practice. We hold or work with carriers and facilities that hold the relevant licences and permits required for waste collection, transport, and disposal.
7.2 The Customer confirms that they are the owner of the Waste or authorised by the owner to arrange its removal and disposal. The Customer warrants that the Waste is as described at the time of Booking and does not contain prohibited or controlled materials unless explicitly declared and agreed.
7.3 We will take reasonable steps to ensure that Waste collected is transferred to a lawful disposal, treatment, or recycling facility. Once Waste has been collected and loaded onto our vehicle, title to the Waste may pass to us, subject to any applicable legal provisions.
7.4 The Customer must not present for collection any illegal items, controlled drugs, unlabelled chemicals, pressurised containers, or other matter that may pose undue risk to people, property, or the environment.
7.5 We aim, where reasonably practical, to divert Waste from landfill through recycling or recovery, but make no guarantee as to the specific method or facility used for final disposal.
8.1 We will exercise reasonable care and skill in providing the Service. However, our liability is limited as set out in this section.
8.2 We are not liable for any damage to property or possessions at the Site arising from pre-existing defects, structural weaknesses, concealed services, poor access, or circumstances not reasonably apparent or disclosed to us.
8.3 The Customer is responsible for removing or protecting items that may be damaged during normal waste removal activities, such as delicate fittings, floor coverings, or decorations in close proximity to the Waste.
8.4 To the fullest extent permitted by law, we exclude liability for any indirect, consequential, or economic loss, including loss of profit, loss of business, loss of data, or loss of opportunity arising from or in connection with the Service or these Terms.
8.5 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
8.6 Subject to the foregoing, our total aggregate liability to the Customer in respect of any claim arising out of or in connection with a specific Booking or Service, whether in contract, tort, or otherwise, shall not exceed the total amount paid or payable by the Customer for that Service.
9.1 The Customer agrees to indemnify and hold us harmless from and against any claims, losses, damages, fines, or expenses arising out of:
a) The Customer's breach of these Terms.
b) The provision of inaccurate, incomplete, or misleading information regarding the Waste or the Site.
c) The presence of hazardous or prohibited materials in the Waste that were not correctly declared.
d) Any failure by the Customer to comply with relevant laws, regulations, or third-party rights.
10.1 If the Customer is dissatisfied with any aspect of the Service, they should notify us as soon as reasonably possible, providing full details of the issue.
10.2 We will investigate complaints in a fair and timely manner and may request additional information or evidence from the Customer.
10.3 Where appropriate, we may offer a remedy such as a partial refund, re-performance of the Service, or another proportionate solution, at our discretion and in accordance with applicable law.
11.1 We will collect and process personal data provided by the Customer for the purposes of managing Bookings, performing the Service, processing payments, and complying with legal obligations.
11.2 We will handle personal data in accordance with applicable UK data protection laws and keep such data secure and confidential, except where disclosure is required by law or necessary for the performance of the Service.
12.1 We may update or amend these Terms from time to time to reflect changes in law, regulations, or our business practices. The latest version will apply to new Bookings from the date of publication or notification.
12.2 Material changes to the Terms will not affect existing confirmed Bookings unless required by law or regulatory guidance. If such changes materially affect the Customer's rights, we will notify the Customer and provide an opportunity to cancel the affected Booking without penalty.
13.1 These Terms, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
13.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service, including any non-contractual disputes or claims.
14.1 If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.
14.2 No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy.
14.3 The Customer may not assign or transfer any of their rights or obligations under these Terms without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary for the proper performance of the Service.
14.4 These Terms, together with the details of the Booking, constitute the entire agreement between the parties in relation to the Service, superseding any prior understandings or arrangements, whether written or oral.
